Meeting: Legal Consultation on Land Dispute

Legal Consultation on Land Dispute
Monday, 25th August 2024, evening

On Monday, 25th August 2024, we attended an appointment at 7.30pm with Lawyer Saruja in Chulipuram regarding an ongoing dispute raised by a neighbour. The issue concerned her claim that there was a right of way along the side of our land, despite there being no fence or access, and despite the matter having already been clarified at the DS office on 11th August 2024 that no legalised path existed.

Prior to the meeting, we had established and found the contact details of the surveyor who had drawn the neighbour’s plan in March 2025 showing a path to the road. We contacted the surveyor, Mr. Liyanage, and he requested that we send the plan to him via WhatsApp so he could review it. Our aim was to confirm whether the plan was genuine and if he had personally prepared it. While waiting at the solicitor’s office, we called Mr. Liyanage, and he confirmed that the plan had been signed by a representative on his behalf. He clarified that he had never attended the site personally; someone else had carried out the site visit.

We arrived at the lawyer’s office promptly, although the office was extremely busy, and the neighbour herself only arrived after 8.00pm. GS Sivaroopan also attended the meeting at the request of the neighbour. We were eventually seen just after 9.00pm.

During the consultation, the solicitor listened carefully to all parties, examined the relevant deeds and land plans, and clarified that while a path did exist to a certain extent, it did not run through Ravi’s land. Instead, the deeds confirmed that the neighbour’s property had access through a longer back route which was explicitly noted. To eliminate any remaining doubts, the lawyer advised the neighbour to obtain further extracts from the Land Registry to confirm beyond question that no path was recorded along Ravi’s property.

We concluded the meeting and left the solicitor’s office at 9.50pm. It remains to be seen whether the neighbour will continue to pursue the matter further or accept the legal advice provided.
